Lacks in the Polish anti-discrimination system in the light
of European standards

ABSTRACT
European Union equality legislation has been expanding its material and personal
scope throughout recent decades. Starting with gender equality in employment, it now
assures the prohibition of discrimination regardless of ethnic origin and race, disability,
age, sexual orientation and religion or belief in different spheres of life. Poland’s accession
to the European Union put an obligation on Poland’s government to introduce effective
legal protection against discrimination into the national legal order. Until recent days,
after six years of Poland’s membership in European structures, Polish law was still not in
compliance with EU’s requirements in relation to equality. As an effect of this resistance,
the European Commission has launched a number of infringement procedures against
Poland for lacks of equality laws at the national level. The recently-adopted law on
equality was heavily criticized by experts and civil society ogranisations which represent
marginalized groups. In order to keep an effective dialogue with Polish authorities, an
informal platform of non-governmental organizations and trade unions (Coalition for
Equal Opportunities) was set up. This is an unprecedented movement in the history of
Polish NGOs, where different stakeholders united in order to level-up the protection
against discrimination in the Polish legal system.
